The court said the trial judge was in error when he failed to place any blame for the accident on Kralik, ruling the $300,000 award excessive. Kralik, who has a Ph.D. in mathematics, fractured his humerus in the incident and argued his injury prevented him from doing jobs requiring lifting or reaching with his right arm.
